Blues may be acquired through the payment methods made available on the Site and used to obtain access to eligible Samples and other digital products.\u003C\u002Fp>\n\n\u003Cp>A “Purchase” means a transaction through which a registered user applies available Blues to obtain access to a Sample or Sample Pack through the Site.\u003C\u002Fp>\n\n\u003Cp>A “User Account” means a registered account required to make Purchases and access account-based features.\u003C\u002Fp>\n\n\u003Cp>By creating a User Account, purchasing Blues, completing a Purchase, accessing digital content, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms.\u003C\u002Fp>\n\n\u003Cp>These Terms should be read together with our \u003Ca href=\"\u002Fprivacy\u002F\">Privacy Policy\u003C\u002Fa> and \u003Ca href=\"\u002Fpayment\u002F\">Payment Terms\u003C\u002Fa>, which form part of the contractual framework governing use of the Site.\u003C\u002Fp>\n\n\u003Cp>If you do not agree to these Terms, you must not create a User Account, make Purchases, or use the account-based services of the Site.\u003C\u002Fp>\n\n\u003Ch2>2. Scope of Services\u003C\u002Fh2>\n\n\u003Cp>The Site is a digital platform offering a curated library of royalty-free audio Samples for musicians, producers, content creators, and other users seeking audio material for creative and commercial projects.\u003C\u002Fp>\n\n\u003Cp>The Company makes Samples available through the Site under CC BY 4.0, subject to the conditions of that licence and the provisions of these Terms.\u003C\u002Fp>\n\n\u003Cp>The Site may provide functionality that allows users to:\u003C\u002Fp>\n\n\u003Cp>(a) browse and preview Samples;\u003C\u002Fp>\n\n\u003Cp>(b) create and manage a User Account;\u003C\u002Fp>\n\n\u003Cp>(c) purchase Blues;\u003C\u002Fp>\n\n\u003Cp>(d) add Samples and Sample Packs to a shopping cart;\u003C\u002Fp>\n\n\u003Cp>(e) complete Purchases using available Blues;\u003C\u002Fp>\n\n\u003Cp>(f) access and download purchased digital content; and\u003C\u002Fp>\n\n\u003Cp>(g) use other account-based or catalogue-related features made available from time to time.\u003C\u002Fp>\n\n\u003Cp>All products supplied through the Site are digital products delivered electronically. No physical goods are sold or shipped.\u003C\u002Fp>\n\n\u003Cp>Payment processing, Blues validity and expiry, transaction completion, cancellations, refunds, billing corrections, chargebacks, and related payment matters are governed by the \u003Ca href=\"\u002Fpayment\u002F\">Payment Terms\u003C\u002Fa>.\u003C\u002Fp>\n\n\u003Cp>Access to and use of the Site are permitted only in accordance with these Terms, the \u003Ca href=\"\u002Fpayment\u002F\">Payment Terms\u003C\u002Fa>, the \u003Ca href=\"\u002Fprivacy\u002F\">Privacy Policy\u003C\u002Fa>, CC BY 4.0 where applicable, and applicable law.\u003C\u002Fp>\n\n\u003Cp>The Company may update, modify, suspend, or discontinue particular features or functionality of the Site where reasonably necessary for operational, technical, legal, security, or business reasons, subject to any rights that cannot lawfully be excluded or restricted.\u003C\u002Fp>\n\n\u003Ch2>3. Eligibility\u003C\u002Fh2>\n\n\u003Cp>The Site and its purchasing functionality are intended solely for adults.\u003C\u002Fp>\n\n\u003Cp>To create a User Account, purchase Blues, make Purchases or otherwise use account-based services, you must:\u003C\u002Fp>\n\n\u003Cp>(a) be at least 18 years old; and\u003C\u002Fp>\n\n\u003Cp>(b) have reached the age of legal majority applicable to you and have the legal capacity to enter into a binding contract.\u003C\u002Fp>\n\n\u003Cp>If the age of legal majority applicable to you is higher than 18, you must have reached that higher age.\u003C\u002Fp>\n\n\u003Cp>Persons who do not satisfy these requirements must not create a User Account or make Purchases through the Site.\u003C\u002Fp>\n\n\u003Cp>By creating a User Account, you represent that you satisfy these eligibility requirements.\u003C\u002Fp>\n\n\u003Ch2>4. User Accounts\u003C\u002Fh2>\n\n\u003Cp>A User Account is required to purchase Samples and access account-related functionality.\u003C\u002Fp>\n\n\u003Cp>You must provide information that is accurate and not misleading and keep relevant account information reasonably up to date.\u003C\u002Fp>\n\n\u003Cp>You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your User Account, except to the extent that applicable law provides otherwise.\u003C\u002Fp>\n\n\u003Cp>You must notify the Company without undue delay if you reasonably believe that your User Account has been accessed without authorisation or affected by a security incident.\u003C\u002Fp>\n\n\u003Cp>The Company may rename, suspend, deactivate or reclaim usernames where reasonably necessary for:\u003C\u002Fp>\n\n\u003Cp>(a) brand protection;\u003C\u002Fp>\n\n\u003Cp>(b) operational integrity;\u003C\u002Fp>\n\n\u003Cp>(c) legal compliance;\u003C\u002Fp>\n\n\u003Cp>(d) security;\u003C\u002Fp>\n\n\u003Cp>(e) prevention of impersonation; or\u003C\u002Fp>\n\n\u003Cp>(f) prevention of misuse.\u003C\u002Fp>\n\n\u003Ch2>5. Blues\u003C\u002Fh2>\n\n\u003Cp>The Platform uses an internal digital unit referred to as Blues.\u003C\u002Fp>\n\n\u003Cp>Blues may be purchased using the payment methods made available on the Platform and may be used solely to purchase eligible products and digital content from us through the Platform.\u003C\u002Fp>\n\n\u003Cp>Blues:\u003C\u002Fp>\n\n\u003Cp>(a) can only be used within the Platform;\u003C\u002Fp>\n\n\u003Cp>(b) cannot normally be transferred between users;\u003C\u002Fp>\n\n\u003Cp>(c) cannot be sold, exchanged or traded outside the Platform;\u003C\u002Fp>\n\n\u003Cp>(d) cannot be withdrawn or redeemed for cash except where a refund is required by applicable law;\u003C\u002Fp>\n\n\u003Cp>(e) do not accrue interest; and\u003C\u002Fp>\n\n\u003Cp>(f) are not intended to operate as a bank account, deposit account, investment product or general-purpose payment instrument.\u003C\u002Fp>\n\n\u003Cp>Purchased Blues do not expire unless a different condition is clearly disclosed before the relevant purchase or expiry is required or permitted by applicable law.\u003C\u002Fp>\n\n\u003Cp>Promotional, complimentary or bonus Blues may be subject to separate conditions, including expiry dates, provided those conditions are disclosed when the Blues are issued.\u003C\u002Fp>\n\n\u003Cp>Additional rules concerning Blues, payments, refunds and chargebacks are set out in our \u003Ca href=\"\u002Fpayment\u002F\">Payment Terms\u003C\u002Fa>.\u003C\u002Fp>\n\n\u003Ch2>6. CC BY 4.0 Licensing\u003C\u002Fh2>\n\n\u003Cp>All Samples offered through the Site are made available under the Creative Commons Attribution 4.0 International Public License unless the Site expressly identifies otherwise.\u003C\u002Fp>\n\n\u003Cp>CC BY 4.0 permits users, subject to the licence conditions, to:\u003C\u002Fp>\n\n\u003Cp>(a) copy and redistribute Samples in any medium or format;\u003C\u002Fp>\n\n\u003Cp>(b) remix, transform and build upon Samples;\u003C\u002Fp>\n\n\u003Cp>(c) incorporate Samples into music, audiovisual works, games, advertisements, podcasts, performances and other creative works; and\u003C\u002Fp>\n\n\u003Cp>(d) use Samples and adaptations for commercial or non-commercial purposes.\u003C\u002Fp>\n\n\u003Cp>The rights provided by CC BY 4.0 are non-exclusive.\u003C\u002Fp>\n\n\u003Cp>Other users may therefore obtain, use, modify or distribute the same Sample.\u003C\u002Fp>\n\n\u003Cp>A Purchase through the Site constitutes payment for obtaining access to the relevant digital content through the Company's platform. It does not convert the CC BY 4.0 licence into an exclusive licence and does not restrict rights otherwise granted under CC BY 4.0.\u003C\u002Fp>\n\n\u003Cp>Once a user has lawfully obtained a Sample under CC BY 4.0, use of that Sample is governed by the applicable CC BY 4.0 licence.\u003C\u002Fp>\n\n\u003Ch2>7. Intellectual Property in the Site\u003C\u002Fh2>\n\n\u003Cp>Except for Samples and other material expressly identified as being made available under CC BY 4.0 or another applicable public licence, intellectual property rights in the Site remain owned by the Company or its licensors.\u003C\u002Fp>\n\n\u003Cp>This includes, where applicable:\u003C\u002Fp>\n\n\u003Cul>\n\u003Cli>trademarks and branding;\u003C\u002Fli>\n\u003Cli>Site design and layout;\u003C\u002Fli>\n\u003Cli>source code and software;\u003C\u002Fli>\n\u003Cli>databases and catalogue organisation;\u003C\u002Fli>\n\u003Cli>graphics and interface elements;\u003C\u002Fli>\n\u003Cli>editorial materials; and\u003C\u002Fli>\n\u003Cli>proprietary administrative systems.\u003C\u002Fli>\n\u003C\u002Ful>\n\n\u003Cp>You may not copy, reproduce, reverse engineer, republish, sell or commercially exploit proprietary elements of the Site except where expressly permitted by law or by the Company.\u003C\u002Fp>\n\n\u003Cp>Nothing in this section restricts rights independently granted in relation to Samples under CC BY 4.0.\u003C\u002Fp>\n\n\u003Ch2>8. Previews\u003C\u002Fh2>\n\n\u003Cp>Audio previews are provided to allow users to evaluate Samples before completing a Purchase through the Site.\u003C\u002Fp>\n\n\u003Cp>Access to a preview does not necessarily provide access to the corresponding downloadable file through the Site.\u003C\u002Fp>\n\n\u003Cp>The technical restrictions applicable to previews and access functionality do not alter any CC BY 4.0 rights that apply to a Sample once the relevant licensed material has been lawfully obtained.\u003C\u002Fp>\n\n\u003Ch2>9. Digital Content and Delivery\u003C\u002Fh2>\n\n\u003Cp>Samples and Sample Packs are supplied electronically through the relevant User Account.\u003C\u002Fp>\n\n\u003Cp>Access is normally granted after the relevant Purchase has been successfully completed and recorded by the Company's systems.\u003C\u002Fp>\n\n\u003Cp>Delivery may occasionally be delayed because of payment verification, technical interruptions, maintenance, connectivity issues, third-party processing or circumstances outside the Company's reasonable control.\u003C\u002Fp>\n\n\u003Cp>Where a completed Purchase is not delivered correctly, remedies may be provided in accordance with the \u003Ca href=\"\u002Fpayment\u002F\">Payment Terms\u003C\u002Fa> and applicable law.\u003C\u002Fp>\n\n\u003Ch2>10. Consumer Rights\u003C\u002Fh2>\n\n\u003Cp>Nothing in these Terms excludes, limits or replaces rights that cannot lawfully be excluded under applicable consumer protection law.\u003C\u002Fp>\n\n\u003Cp>Where UK consumer law applies, digital content supplied through the Site remains subject to applicable statutory standards and remedies.\u003C\u002Fp>\n\n\u003Cp>The fact that Samples are licensed under CC BY 4.0 does not remove statutory obligations that may apply to the Company's paid supply of digital content or access through the Site.\u003C\u002Fp>\n\n\u003Ch2>11. Disclaimer and Availability\u003C\u002Fh2>\n\n\u003Cp>Subject to mandatory rights under applicable law, the Site is provided on an “as is” and “as available” basis.\u003C\u002Fp>\n\n\u003Cp>The Company does not guarantee that the Site, its functionality or access to its services will always be uninterrupted, error-free, secure or free from harmful components.\u003C\u002Fp>\n\n\u003Cp>The Company does not guarantee that any particular Sample will meet a user's artistic expectations, production requirements or intended creative result.\u003C\u002Fp>\n\n\u003Cp>Samples are non-exclusive, and the Company does not guarantee that a Sample, adaptation or Creative Work incorporating a Sample will be unique.\u003C\u002Fp>\n\n\u003Cp>CC BY 4.0 itself may not provide every permission necessary for every intended use. Users should consider whether additional rights or permissions are required for their particular circumstances.\u003C\u002Fp>\n\n\u003Ch2>12. User Responsibility and Indemnity\u003C\u002Fh2>\n\n\u003Cp>Users are responsible for their own use of Samples and for ensuring compliance with CC BY 4.0, applicable law and any third-party rights relevant to their intended use.\u003C\u002Fp>\n\n\u003Cp>If you use the Site wholly or mainly in the course of a trade, business or profession, you agree, to the extent permitted by applicable law, to indemnify the Company against reasonable losses, liabilities, damages and legal costs arising directly from:\u003C\u002Fp>\n\n\u003Cp>(a) your material breach of these Terms;\u003C\u002Fp>\n\n\u003Cp>(b) your unlawful use of the Site;\u003C\u002Fp>\n\n\u003Cp>(c) your use of a Sample in violation of CC BY 4.0; or\u003C\u002Fp>\n\n\u003Cp>(d) your infringement of third-party rights arising from your particular use of a Sample.\u003C\u002Fp>\n\n\u003Cp>This section does not impose liability on a consumer where doing so would be prohibited or unfair under applicable consumer law.\u003C\u002Fp>\n\n\u003Ch2>13. Suspension and Termination\u003C\u002Fh2>\n\n\u003Cp>The Company may suspend, restrict or terminate access to the Site or a User Account where it reasonably believes that:\u003C\u002Fp>\n\n\u003Cp>(a) these Terms have been materially breached;\u003C\u002Fp>\n\n\u003Cp>(b) the Site has been used fraudulently or unlawfully;\u003C\u002Fp>\n\n\u003Cp>(c) account security has been compromised;\u003C\u002Fp>\n\n\u003Cp>(d) payment fraud or abuse has occurred; or\u003C\u002Fp>\n\n\u003Cp>(e) suspension is reasonably necessary for legal, regulatory or security reasons.\u003C\u002Fp>\n\n\u003Cp>Suspension or termination of a User Account does not itself revoke rights validly granted under CC BY 4.0 in relation to Samples already lawfully obtained.\u003C\u002Fp>\n\n\u003Cp>Termination, expiry and reinstatement of rights under CC BY 4.0 are governed by the CC BY 4.0 licence itself.\u003C\u002Fp>\n\n\u003Cp>Termination of a User Account does not affect completed transactions, accrued rights, payment obligations or provisions that by their nature are intended to survive termination.\u003C\u002Fp>\n\n\u003Ch2>14. Changes to These Terms\u003C\u002Fh2>\n\n\u003Cp>The Company may update these Terms from time to time.\u003C\u002Fp>\n\n\u003Cp>Updated Terms will be published on the Site with a revised “Last Updated” date.\u003C\u002Fp>\n\n\u003Cp>Where required by applicable law, reasonable notice of material changes will be provided.\u003C\u002Fp>\n\n\u003Cp>Changes to these Terms do not retrospectively alter the terms of CC BY 4.0 applicable to Samples already distributed under that licence.\u003C\u002Fp>\n\n\u003Cp>Continued use of the Site after revised Terms take effect constitutes acceptance of those Terms to the extent permitted by applicable law.\u003C\u002Fp>\n\n\u003Ch2>15. Severability and No Waiver\u003C\u002Fh2>\n\n\u003Cp>If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply.\u003C\u002Fp>\n\n\u003Cp>Failure by the Company to immediately enforce a right under these Terms does not constitute a waiver of that right.\u003C\u002Fp>\n\n\u003Ch2>16.
